US Judge Orders Release of Abrego Garcia from ICE Custody
A federal judge has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement is without legal authority.
"Since his return from wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her ruling.
The case stems from a mistaken removal to El Salvador earlier this year, which US authorities later admitted was an error. Following his return to the United States to face alien smuggling charges, he was held in federal custody.
In her order, the court noted that the authorities does not have a valid removal order, which prevents them from removing Mr. Abrego Garcia "for now."

The court challenge center on conflicting assertions. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this allegation.
He has also pleaded not guilty to the smuggling counts, which are part of a ongoing trial in Tennessee.
